Belgium court limits public Masses at Christmas

Belgium’s Council of State prohibits the celebration of Masses on Christmas with a congregation of more than 15 participants, due to coronavirus-related restrictions.

It will be a Christmas without large public Masses in Belgium this year.

The Council of State, Belgium’s highest administrative court, confirmed the ban on Tuesday in response to a petition from a group of Catholic priests.

The group had appealed against a ministerial order issued on 11 December, which limited public gatherings for worship to 15 participants.

‘Not contrary to religious freedom’

The court rejected the request on the grounds that the restrictions are necessary “to preserve public health in the context of the coronavirus pandemic.”

“These requests were directed against the ministerial order of December 11, 2020, which once again authorized the collective exercise of worship in buildings, but limited it to a maximum of 15 people,” reads the ruling. “In particular, this regulation is not contrary to the freedom of religion, the principle of equality, or the principle of proportionality.”

‘Concerning development’

The spokesman of the Belgian Bishops’ Conference, Fr. Tommy Scholtes, expressed regret at the decision, speaking to RTBF, a Belgian broadcaster.

He said the Council of State “did not accept the arguments of these priests who were trying to save Christmas.”

The group of priests who brought the appeal called the ruling “a serious development in the protection of individual rights, which every citizen of this country should be concerned about.”

They added that the Council of State has given the government “a wide margin of discretion in assessing whether or not to severely restrict freedom of worship.”

‘No proportionality’

Ahead of the 11 December order that restricted access to public worship, Belgian Catholics had hoped for more flexibility on congregation sizes.

Many had anticipated measures that took into account the size of the place of worship, as Italy and France had done.

One of those who lodged the appeal is the Rector of the Basilica of the Sacred Heart in Koekelberg, Father Marc Leroy.

He complained that only 15 people are allowed to enter his church, which is the largest in Belgium and measures over 10,000 square meters.

In normal times, the church welcomes around 700 of the faithful.

“I don’t think the politicians really know what is going on at the moment,” he lamented.

Raad van State: geen uitbreiding van 15 personen in de H Mis

Voor de raad van State is er geen onredelijkheid om de eredienst te beperken tot 15 personen. De raad van State is ook van oordeel dat deze regeling niet strijdig is met onder meer de godsdienstvrijheid, met het gelijkheidsbeginsel en het proportionaliteitsbeginsel

Opeengepakt in de luchthaven kan wel, volle winkelstraten kan ook, maar dat is proportioneel overeenkomstig met een kathedraal met 15 personen in (en dus gemiddeld 30 meter uit elkaar dan).

Het gaat er gewoon om dat de Katholieke gemeenschap in dit land te klein is en te weinig van haar oren kan maken, en geen leiders heeft die ook de intentie hebben om te zoeken naar oplossingen (in Vlaanderen dus geen drive-in Kerstnachtmis zoals in het Bisdom Roermond). 

Vanavond dus opnieuw demonstratie voor de Kathedralen tegen deze onredelijkheid en manifest ongelijke behandeling van de eredienst.

Bisdom Antwerpen: 

Wij stellen vast dat op een aantal plekken in ons bisdom het voorstel aan gelovigen wordt gedaan om na een gestreamde viering gelovigen naar de kerk uit te nodigen om ze daar  een communie te geven.

Wij begrijpen dat gelovigen creatief zijn in het zoeken naar alternatieven om de H. Communie, het heilige teken dat ons zo verbindt, toch te kunnen ontvangen maar dit voorstel gaat te ver. Daarom vragen we met aandrang aan alle PE en parochies van het bisdom Antwerpen om dit voorstel niet te doen.

De bisschoppen drukken nogmaals hun solidariteit uit met de regering, de zorgsector en alle anderen die onvermoeibaar strijden tegen het virus. Ze verdienen alle steun.

Dindag 15 december: gebed voor de Kathedraal om 19 uur voor de openstelling van de Eredienst

 

De regering met Quickie lacht ons uit.

Zou er in Vlaanderen nog iemand zijn die het hoog op heeft met de bisschoppen? Ze zijn totaal afwezig. Ze willen absoluut dat alle communicatie via kerknet loopt, maar daar staat nooit iets actueel op. Zouden ze nu opnieuw de staat gaan bedanken dat we met 15 naar de Mis mogen, om vervolgens te zeggen dat dat praktisch onhaalbaar is en ze dus verder gaan met de mensen de Sacramenten te onthouden? 

En gaan we dan over een jaar terug catechese krijgen van diezelfde bisschoppen over hoe essentieel de sacramenten wel niet zijn? 

Overigens toont de hele crisis wel hoe ingestort de Kerk in Vlaanderen wel is. In Nederland en Frankrijk is er nog een duidelijke tegenstand van de leken. In Vlaanderen haalt men met moeite, en dan nog met buitenlandse steun, een petitie van 10 000 man... 

Als de bisschoppen zo voortdoen om te weigeren te getuigen van het belang van de Sacramenten voor ons, dan zijn we binnenkort niet meer met 15. Dan is het ook opgelost natuurlijk.
